Privacy Policy

1. Introduction

This Privacy Policy describes how Global Tech Operations LLC ("Company," "we," "us," or "our") collects, uses, discloses, and protects your personal information when you use the Socrates AI mobile application (the "App") and the website located at www.socrateschat.com (the "Website") (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please do not use the Service.

2. Information We Collect

2.1 Account Information

When you create an account, we collect your email address for authentication purposes. You may also provide a display name during onboarding.

2.2 Onboarding and Preference Data

During onboarding, we collect your interests and content preferences to personalize your experience. This includes whether you have opted in to NSFW (adult) content, which requires you to confirm you are at least 18 years old.

2.3 Conversation Content

We collect the text messages you send to AI personas and the AI-generated responses. This content is stored on our servers to maintain your conversation history and enable the App Memory feature.

2.4 Voice Data

If you use voice messaging or live voice sessions, we collect and store voice recordings. Voice data may be processed to generate text for AI interactions.

2.5 Images and Files

We collect images and files you upload, including profile images and content shared within the App. AI-generated images created at your request are also stored.

2.6 App Memory

The App includes an "App Memory" feature that allows AI personas to remember information you share across conversations. This may include facts, preferences, and personal details you provide during chats. Memory entries are stored on our servers and are used solely to personalize your AI interactions. You can view, edit, and delete memory entries at any time through the App's settings.

2.7 User-Created Content

If you create custom AI personas, we collect the persona definitions, instructions, and associated images. We also collect any content you post to the social feed, including comments.

2.8 Device and Technical Information

We collect device identifiers (such as push notification tokens), device type, operating system version, and app version. This information is used to deliver push notifications and ensure compatibility.

2.9 Usage Data

We automatically collect information about how you interact with the Service, including features used, session duration, and interaction patterns. This data is used to improve the Service.

2.10 Subscription Data

Subscription purchases are processed by Apple through In-App Purchase. We receive subscription status information (such as whether you have an active subscription and its expiration date) through our subscription management provider, RevenueCat. We do not collect or store your payment card details, billing address, or other payment information.

3. How We Use Your Information

We use the information we collect to:

  • Provide the Service: Generate AI responses to your messages, maintain conversation history, and deliver voice and feed features.
  • Personalize your experience: Use your preferences, interests, and App Memory entries to tailor AI interactions.
  • Deliver notifications: Send push notifications, including background messages from AI personas, using your device push tokens.
  • Authenticate your account: Send one-time passcodes (OTP) to your email address for login verification.
  • Moderate content: Review content for compliance with our Terms of Service and applicable law.
  • Manage subscriptions: Track your subscription status and provide access to premium features.
  • Improve the Service: Analyze usage patterns to identify bugs, improve features, and develop new functionality.
  • Communicate with you: Send service-related communications such as account verification, security alerts, and policy updates.

4. Third-Party AI Processing

Your conversation content is processed by third-party artificial intelligence providers to generate AI responses. This is a core function of the Service, and by using it, you acknowledge and consent to this processing.

  • xAI (Grok): Your text messages and conversation context are sent to xAI's API to generate AI persona responses. xAI processes this data in accordance with its own privacy policy, available at https://x.ai/legal/privacy-policy.
  • OpenAI: Image generation requests are processed by OpenAI's API. OpenAI processes this data in accordance with its own privacy policy, available at https://openai.com/policies/privacy-policy.

We do not control and are not responsible for the data practices of these third-party AI providers. We encourage you to review their privacy policies. These providers may use data they receive to improve their models and services, subject to their own terms and policies.

5. Third-Party Service Providers

We use the following third-party service providers to operate the Service:

  • DigitalOcean: Cloud hosting and file storage (images, voice recordings, and uploaded files).
  • SendGrid (Twilio): Transactional email delivery for OTP verification codes and service communications.
  • OneSignal: Push notification delivery. OneSignal receives your device push token to deliver notifications.
  • RevenueCat: Subscription management and analytics. RevenueCat receives your subscription status from Apple.
  • Apple: In-App Purchase processing, push notification delivery (APNS), and App Store distribution.

Each provider processes data in accordance with its own privacy policy. We share only the minimum data necessary for each provider to perform its function.

6. Data Storage and Security

Your data is stored on secured servers. Files, images, and voice recordings are stored on DigitalOcean Spaces with encryption at rest. We implement industry-standard security measures, including encrypted data transmission (TLS/SSL), secure authentication (JWT), and access controls.

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You use the Service at your own risk.

7. Data Retention

  • Account data is retained for as long as your account is active.
  • Conversation data is retained until you delete individual conversations or your account.
  • App Memory entries are retained until you manually clear them or delete your account.
  • Voice recordings are retained as part of your conversation history until deleted.
  • Upon account deletion, we will delete your personal data within 30 days. Backup copies may be retained for up to an additional 30 days before being permanently removed.

We may retain anonymized or aggregated data that cannot be used to identify you for analytical purposes indefinitely.

8. Your Rights and Choices

  • Account deletion: You can delete your account at any time through the App (Settings > Delete Account). You may also request deletion by emailing support@socrateschat.com. All associated data will be deleted within 30 days.
  • App Memory: You can view, edit, and clear all memory entries in the App's settings. You can also pause the memory feature to prevent new entries from being saved.
  • Conversation deletion: You can delete individual conversations and their contents from within the App.
  • Push notifications: You can disable push notifications through your device settings. You can also disable background messages from AI personas in the App's settings.
  • NSFW content: You can enable or disable NSFW content at any time in the App's settings.

9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act and the California Privacy Rights Act:

  • Right to know: You may request that we disclose what personal information we have collected about you, the categories of sources, the purposes for collection, and the categories of third parties with whom we share it.
  • Right to delete: You may request that we delete your personal information, subject to certain exceptions.
  • Right to correct: You may request that we correct inaccurate personal information.
  • Right to opt out of sale or sharing: We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.
  • Right to non-discrimination: We will not discriminate against you for exercising your privacy rights.

To exercise your rights, email us at support@socrateschat.com with the subject line "CCPA Request." We will verify your identity and respond within 45 days.

10. European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, you have the following rights under the General Data Protection Regulation:

  • Legal basis for processing: We process your data based on (a) your consent, (b) performance of a contract (providing the Service), and (c) our legitimate interests (improving the Service, preventing abuse).
  • Right of access: You may request a copy of your personal data.
  • Right to rectification: You may request correction of inaccurate data.
  • Right to erasure: You may request deletion of your personal data.
  • Right to restriction: You may request that we limit processing of your data.
  • Right to data portability: You may request your data in a structured, machine-readable format.
  • Right to object: You may object to processing based on legitimate interests.
  • Right to withdraw consent: Where processing is based on consent, you may withdraw it at any time.

International data transfers: Your data may be transferred to and processed in the United States. By using the Service, you consent to this transfer. We take reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy.

11. Children's Privacy

The Service is not intended for children under the age of 13 (or under 16 in the EEA). We do not knowingly collect personal information from children under these ages. NSFW content is restricted to users who are at least 18 years old.

If we become aware that we have collected personal information from a child under the applicable age, we will take steps to delete that information promptly. If you believe a child has provided us with personal information, please contact us at support@socrateschat.com.

12. Push Notifications and Background Messages

AI personas may send you proactive messages ("background messages") outside of active chat sessions. These messages are delivered as push notifications through OneSignal and Apple Push Notification Service (APNS).

To receive push notifications, your device push token is collected and stored. You can disable background messages in the App's settings (Settings > Notifications > Background Messages) and can set "Quiet Hours" during which no background messages will be sent. You can also disable all push notifications through your device's system settings.

13. Cookies and Website Tracking

The Website (www.socrateschat.com) may use essential cookies required for basic website functionality. We do not use advertising cookies or third-party tracking cookies. We do not engage in cross-site tracking or behavioral advertising.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you through the App or by email. The "Last updated" date at the top of this page indicates when this policy was most recently revised. Your continued use of the Service after any changes constitutes your acceptance of the updated Privacy Policy.
